Article 5: Vehicle & Driver Handover

  1. Party A shall deliver the vehicle and assigned driver before the rental period starts, providing relevant documents.
  2. Party B shall inspect the vehicle and driver, and sign the Vehicle & Driver Handover Confirmation Form.
  3. At the end of the rental period, Party B shall return the vehicle and conclude the driver service as agreed.

Article 6: Vehicle & Driver Usage Rules

  1. Party B shall not use the vehicle or driver for illegal activities.
  2. Driver management is the responsibility of Party A; Party B may reasonably schedule the driver’s work according to the itinerary.
  3. Party B shall not interfere with the driver’s normal operation or management.
  4. During the rental period, Party B shall use the vehicle according to the agreed route or schedule; any changes must be notified in advance.

Article 7: Insurance & Accident Handling

  1. The vehicle is insured with mandatory and commercial insurance, according to the policy.
  2. In case of an accident, Party B shall immediately notify the police and Party A, and cooperate with the driver to handle the situation.
  3. Losses caused by Party B’s violation or driver’s operation shall be borne by the responsible party.

Article 8: Breach of Contract

  1. If Party B delays payment or does not use the vehicle as agreed, Party A has the right to claim a penalty.
  2. Party B shall bear full compensation for any damage to the vehicle or third-party property.
  3. If Party A fails to provide the vehicle or driver as agreed, Party A shall refund payments and bear the penalty.

Article 9: Termination of Contract

  1. The contract may be terminated by mutual agreement.
  2. Party A may unilaterally terminate the contract and reclaim the vehicle if Party B:
    • Defaults on rental or service fees;
    • Uses the vehicle for illegal purposes;
    • Interferes with the driver’s normal work.

Article 10: Dispute Resolution

  1. This contract shall be governed by the laws of the place of signing.
  2. Any disputes shall first be resolved through negotiation; if unsuccessful, disputes may be submitted to the local court or arbitration institution.

Article 11: Other Provisions

  1. Matters not covered in this contract may be addressed through a written supplementary agreement, which has the same legal effect as this contract.
  2. This contract is made in two copies, one for each party, effective upon signing.
