Preamble:
Party A legally owns or manages the commercial vehicle(s), and Party B, for business operations, intends to lease the vehicle(s). Both parties, on the basis of equality, voluntariness, and good faith, agree as follows:

Article 1: Vehicle Information

  1. Vehicle Type: _________________________ (e.g., truck, passenger vehicle, construction vehicle, etc.)

  3. Vehicle Condition: Party A guarantees that the vehicle meets road safety technical requirements and is insured with mandatory and commercial insurance.

Article 2: Lease Term

  2. End Date: ____ / ____ / ____ (YYYY/MM/DD)
  3. Upon expiration, Party B shall return the vehicle on time. For extension, Party B shall notify Party A in writing ____ days in advance and sign a supplementary agreement.

Article 3: Rent and Expenses

  2. Payment Method: Party B shall pay rent as follows: _________________________ (one-time payment / installment).
  3. Other Expenses:
    • Fuel, tolls, and parking fees borne by Party B;

Article 4: Deposit & Penalty

  1. Deposit: Party B shall pay a deposit of RMB ______ as a guarantee for vehicle damage, traffic violations, or other costs. It will be refunded upon contract termination if the vehicle is intact.
  2. If Party B fails to pay rent on time or damages the vehicle, Party A may deduct corresponding costs from the deposit.

Article 5: Rights and Obligations

  1. Party A Rights & Obligations:
    • Ensure the vehicle’s legal ownership and complete documentation;
    • Not reclaim the vehicle without cause during the lease term;
    • Maintain necessary insurance and annual inspection.
  2. Party B Rights & Obligations:
    • Pay rent and related costs according to the contract;
    • Use the vehicle properly, not sublease, lend, or use it illegally;
    • Bear responsibility for damage or accidents caused by improper operation;
    • Return the vehicle on time upon lease expiration.

Article 6: Insurance & Accident Handling

  1. Vehicle is insured with mandatory and commercial insurance (subject to the policy).
  2. In case of an accident, Party B shall immediately report to the police and notify Party A, and cooperate with insurance claims.
  3. Losses caused by Party B’s violations or insurance rejection shall be borne by Party B.

Article 7: Termination of Contract

  1. The contract may be terminated by mutual agreement.
  2. Party A may terminate the contract and reclaim the vehicle if Party B:
    • Delays rent payment for more than ______ days;
    • Uses the vehicle for illegal activities;
    • Subleases or lends the vehicle without permission.

Article 8: Breach of Contract

  1. If Party B returns the vehicle late, an overdue fee of RMB ______ / day shall be charged.
  2. If Party B’s breach prevents contract fulfillment, the deposit will not be refunded, and Party B shall compensate Party A for losses.
  3. If Party A fails to deliver the vehicle on time, Party A shall refund payments and pay a penalty.

Article 9: Dispute Resolution

In case of disputes during the execution of this contract, both parties shall negotiate in good faith. If negotiation fails, disputes shall be submitted to the People’s Court at Party A’s location.

Article 10: Miscellaneous

  1. Matters not covered in this contract may be addressed through a written supplementary agreement.
  2. This contract may be signed electronically or in writing and shall have the same legal effect.
