In view of Party A legally operating a car-sharing platform and Party B voluntarily renting a vehicle through the platform, both parties, on the basis of equality, voluntariness, and good faith, agree on the following terms for car-sharing rental:

1. Vehicle Information

  3. Vehicle Condition: Party A guarantees that the rented vehicle meets road traffic safety technical requirements and is insured with mandatory traffic insurance and commercial insurance.

2. Rental Period

  3. If an extension is required, Party B must apply through the platform, and it becomes effective after Party A’s confirmation.

3. Rental Fee and Other Charges

  2. Payment Method: Party B shall settle via the payment method linked to their platform account.
  3. Other Charges:
    1. Overtime Fee: Charged according to the platform’s standards if exceeding the rental period.
    2. Extra Mileage Fee: If the platform sets a mileage limit, excess mileage will be charged.
    3. Fuel/Electricity Costs: Costs incurred during use are borne by Party B (unless otherwise agreed).
    4. Parking, tolls, and other fees are borne by Party B.

4. Deposit and Penalty

  1. Deposit: Party B shall pay a deposit of RMB ______, refundable upon contract termination if the vehicle is intact.
  2. Party A may deduct from the deposit if Party B:
    1. Damages or loses the vehicle;
    2. Receives traffic violation fines;
    3. Subleases or lends the vehicle without permission;
    4. Defaults on rental fees or other charges.

5. Rights and Obligations

5.1 Party A (Lessor):

  1. Ensure the vehicle is legal and fully insured.
  2. Provide 24-hour customer service and roadside assistance.
  3. Monitor vehicle location and usage via onboard systems.
  4. If Party B breaches the contract, Party A may remotely terminate vehicle use.

5.2 Party B (Lessee):

  1. Use the vehicle legally; not for illegal activities, commercial transport, modifications, or racing.
  2. Keep the vehicle safe; do not sublease, lend, or pledge it.
  3. Bear any losses or liabilities caused by improper or illegal operation.
  4. Return the vehicle at the agreed time and location.

6. Insurance and Accident Handling

  1. The vehicle is insured with mandatory traffic insurance and commercial insurance; coverage is subject to the insurance policy.
  2. In case of an accident, Party B must report to the police immediately and notify Party A; no private settlements are allowed.
  3. Losses arising from Party B’s liability causing insurance refusal are borne by Party B.

7. Termination of Contract

  1. Both parties may terminate the contract by mutual agreement.
  2. Party A may unilaterally terminate the contract and repossess the vehicle if Party B:
    1. Delays payment for more than 24 hours;
    2. Subleases the vehicle without permission;
    3. Uses the vehicle for illegal activities.

8. Breach of Contract

  1. If Party B fails to return the vehicle on time, overtime fees and penalties apply.
  2. If Party A fails to provide the vehicle as agreed, Party A shall refund payments and assume corresponding liability.

9. Dispute Resolution

Any disputes arising during the execution of this contract shall be resolved through friendly negotiation; if negotiation fails, the dispute shall be submitted to the People’s Court at Party A’s location.

10. Miscellaneous

  1. This contract is concluded electronically and has the same legal effect as a written contract.
  2. Matters not covered in this contract shall follow platform rules and relevant laws and regulations.
